Review HOA covenants, conditions, and restrictions (CC&Rs)

5

If your property is part of a homeowner association, review the CC&Rs (Covenants, Conditions & Restrictions) for any rules about animals, livestock, or poultry. HOA rules are legally binding and often stricter than municipal codes. Many HOAs prohibit chickens entirely, while others restrict coop placement, appearance, or flock size. Even if your city allows chickens, your HOA can override that permission.

Why It Works

HOA CC&Rs are private contractual agreements that you accepted when purchasing your home. Violating them can result in fines, liens on your property, and forced removal of your flock. Some states have "right-to-farm" laws that may protect agricultural activities in certain zones, but these rarely override HOA restrictions in suburban developments.

Tips

  • Read the CC&Rs carefully for terms like "livestock," "farm animals," "poultry," and "domestic animals"
  • Check both the original CC&Rs and any amendments — rules may have been added or relaxed over time
  • If the CC&Rs are silent on poultry, request a written ruling from the HOA board before getting chickens
  • Some homeowners have successfully petitioned their HOA to amend rules — approach the board with a well-prepared proposal addressing noise, odor, and appearance concerns
